This Privacy Policy explains how Excelhire LLC (“Excelhire,” “we,” “us,” or “our”) collects, uses, processes, shares, and protects information in connection with the Excelhire recruitment platform, our websites, and the Excelhire mobile application (collectively, the “Service”). It also explains your privacy rights and choices. 

Excelhire is a business-to-business (B2B) software-as-a-service (SaaS) platform made available by subscription to staffing and recruitment organizations. If you use the Service as an employee, administrator, contractor, or other authorized user of an organization, your use may also be governed by that organization’s privacy policies and its agreement with Excelhire. 

By accessing or using the Service, you acknowledge that you have read this Privacy Policy. 

1. Scope and Our Role 

Each staffing or recruitment organization that subscribes to Excelhire (an “Organization” or “Customer”) determines how its business and recruitment data is used. For Organization-controlled Personal Data, the Organization generally acts as the data controller or business, and Excelhire generally acts as a processor or service provider on the Organization’s behalf and under its instructions. 

Depending on the context and applicable law, Excelhire may act independently with respect to certain account, website, support, billing, security, compliance, and service-operations information. 

Accounts are provisioned by an Organization’s administrator. The Excelhire mobile application requires an active Excelhire account; it has no public self-registration and is intended only for authorized business users. 

The full recruitment platform is provided through the Excelhire web application. The Excelhire Mobile App offers a limited subset of the Service: it is intended primarily for an Organization’s executives (such as CEOs and senior leaders) to view their Organization’s revenue and performance dashboards and to ask questions about that information in real time through the in-app AI assistant. Access to these features depends on the user’s role and permissions within their Organization. 

2. Definitions 

  • Account: A unique account created for you to access the Service or specific features of the Service. 
  • Authorized User: An individual granted access to the Service by an Organization, such as an administrator, executive, manager, recruiter, employee, or contractor. 
  • Company / We / Us / Our: Excelhire LLC, 7700 Preston Rd #402, Frisco, TX 75034, United States. 
  • Cookies: Small data files placed on a browser or device to support website functionality, remember preferences, and collect information about use of the Service. 
  • Device: A computer, mobile phone, tablet, or other device capable of accessing the Service. 
  • Excelhire Mobile App: The mobile application provided by Excelhire as part of the Service. 
  • Organization or Customer: A business that subscribes to Excelhire. 
  • Personal Data: Information that relates to an identified or identifiable individual. 
  • Service: The Excelhire recruitment platform, the Excelhire Mobile App, and Excelhire websites, including https://excelhire.us. 
  • Service Provider or Sub-processor: A third party that processes Personal Data on our behalf or helps us operate, secure, support, analyze, or provide the Service. 
  • Usage Data: Information collected automatically from use of the Service or its supporting infrastructure, such as device information, log information, and the duration of a page visit. 
  • You: The individual accessing or using the Service, or the legal entity on whose behalf the individual accesses or uses the Service, as applicable. 

3. Information We Collect 

The information we collect depends on how you use the Service and the features enabled by your Organization. 

3.1 Account and Contact Information 

  • First and last name. 
  • Work email address. 
  • Phone number. 
  • Address, state, province, ZIP or postal code, and city, when provided. 
  • Organization identifier. 
  • User role or user type. 
  • Authentication information, including tokens issued when you sign in. 

3.2 Organization Business Data 

We process recruitment, operational, and revenue-related data that Authorized Users create, upload, access, or query through the Service, which may include candidate and job-seeker records, jobs and job requirements, client information, candidate submissions, pipeline stages and status history, placements, and revenue and performance metrics. This information belongs to and is controlled by the relevant Organization, subject to applicable law and contractual terms. 

3.3 Content Submitted to the AI Assistant 

We collect questions and instructions that Authorized Users type or speak to the in-app AI assistant, together with the responses generated for those users. 

3.4 Voice and Microphone Data 

If you enable voice mode in the Excelhire Mobile App, the app accesses your device microphone, only after you grant permission, to capture spoken requests for transcription and to provide spoken responses. Voice features are optional; the AI assistant may also be used by typing. You may grant or revoke microphone permission at any time through your device settings. Revoking microphone permission disables voice functionality only; you may continue using the AI assistant by typing. 

3.5 Usage and Device Data 

Usage Data is collected automatically when you use the Service and may include your IP address; browser type and version; pages or features accessed; date and time of access; time spent on pages or features; unique device identifiers and diagnostic data; device type, operating system, and app version; and authentication and security events. We may also receive information that your browser or mobile device sends when you access the Service. 

4. Cookies and Similar Technologies 

We use Cookies and similar technologies, such as web beacons, tags, scripts, and local storage, to operate the Service, remember preferences, understand usage, and support security and troubleshooting. You can configure your browser to refuse some or all Cookies or to notify you when a Cookie is being sent. If you disable Cookies, some parts of the Service may not function properly. 

5. How We Use Information 

We may use Personal Data and other information to: 

  • Provide, operate, maintain, and monitor the Service. 
  • Create, administer, and secure Accounts, including authentication and role-based access. 
  • Display an Organization’s recruitment and revenue data to its Authorized Users. 
  • Perform our contractual obligations and process data on behalf of the relevant Organization. 
  • Operate AI-powered chat, transcription, and voice-response features. 
  • Respond to support requests and manage user requests. 
  • Communicate by email, phone, SMS, or similar methods regarding support, product updates, service announcements, security matters, and important notices. 
  • Provide news, offers, and general information where permitted by applicable law. 
  • Analyze usage and trends, troubleshoot issues, and improve the Service. 
  • Protect the confidentiality, integrity, availability, and security of the Service. 
  • Comply with legal obligations and enforce our agreements. 
  • Evaluate or complete a merger, financing, restructuring, acquisition, sale, or other business transaction. 

6. How We Share Information 

We do not sell Personal Data, and we do not use Personal Data for cross-app tracking or for advertising purposes. We do not use data to track you across apps or websites owned by other companies. We share information only as described below. 

6.1 Service Providers and Sub-processors 

We may share information with trusted vendors that help us operate and provide the Service, including: 

  • OpenAI, for AI-powered chat reasoning, speech-to-text transcription, and text-to-speech functionality. 
  • Cloud hosting, infrastructure, security, monitoring, and related technology providers. 

These providers are required by contract to protect information, maintain confidentiality, and process Personal Data only for authorized purposes. 

6.2 Within Your Organization 

Information is available to Authorized Users within your Organization according to their assigned roles and permissions. 

6.3 Legal, Safety, and Compliance Reasons 

We may disclose information when we reasonably believe disclosure is necessary to comply with applicable law, regulation, legal process, or a valid request from a public authority; protect and defend the rights or property of Excelhire; prevent, detect, or investigate wrongdoing, security incidents, fraud, or potential violations; protect the personal safety of users, Customers, or the public; or protect against legal liability. 

6.4 Business Transactions 

Information may be transferred or disclosed in connection with a merger, acquisition, restructuring, financing, asset sale, or similar business transaction. 

7. AI-Powered Chat and Voice Features 

The Service includes an AI-powered assistant that allows Authorized Users to ask natural-language questions about their Organization’s recruitment activities, pipeline, and revenue information. Questions may be submitted by typing or speaking. Spoken questions are transcribed into text for processing, and AI-generated responses may be presented as text or spoken audio. 

7.1 Third-Party AI Processing 

To interpret a request and generate a response, the typed text or transcribed voice request, together with only the Organization data required to answer the request, may be processed by OpenAI acting as a Sub-processor on behalf of Excelhire. This processing is performed solely to generate the response requested by the Authorized User. Your Organization’s information is not used to train models operated by OpenAI or any other third party. 

7.2 Voice Processing and Permissions 

  • The app accesses your device microphone only after you grant permission. 
  • Spoken audio is used for transcription, and generated response content may be converted into spoken audio where that feature is enabled. 
  • Raw voice recordings are not retained longer than necessary to process the request. 
  • You may grant or revoke microphone permission at any time through your device settings. Revoking microphone permission disables voice functionality only; you may continue using the AI assistant by typing. 

8. Data Retention 

We retain Personal Data only for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, protect the Service, and enforce our agreements. 

Organization business data is retained according to the Organization’s subscription, contractual requirements, applicable law, and instructions. Usage Data may be retained for security, support, analytics, and service-improvement purposes. When voice features are used, spoken requests are processed to fulfill the request, and raw voice recordings are not retained beyond the period necessary to process the request. 

9. International Data Transfers 

Personal Data may be processed at Excelhire’s operating locations and in other locations where our Service Providers or Sub-processors operate. As a result, information may be transferred to and maintained in countries or jurisdictions other than the one in which you reside. Where required by applicable law, we use appropriate safeguards for international transfers of Personal Data. 

10. Security and Data Isolation 

We use commercially reasonable technical and organizational safeguards designed to protect Personal Data and Organization information. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. Our safeguards include, as appropriate: 

  • Encryption of data during transmission. 
  • Role-based access controls and permissions. 
  • Secure storage of authentication credentials, including the iOS Keychain on supported mobile devices. 
  • Monitoring and security practices designed to protect the confidentiality, integrity, and availability of the Service. 

10.1 Multi-Tenancy and Data Isolation 

Excelhire operates as a multi-tenant SaaS platform. Each Organization’s data is logically isolated and scoped to that Organization. Authorized Users may access only the data permitted by their Organization and assigned roles. Excelhire does not disclose one Customer’s recruitment or business data to another Customer. 

11. Your Privacy Rights and Choices 

Depending on your location and applicable law, you may have rights regarding your Personal Data, which may include the right to access your Personal Data, request correction of inaccurate Personal Data, request deletion of Personal Data where applicable, request restriction of certain processing, and object to certain processing activities where permitted by law. 

Because Organizations control much of the Personal Data processed through the Service, requests concerning Organization-controlled data should generally be directed to the relevant Organization or its administrator. Excelhire will assist Customers in responding to such requests where appropriate. To exercise rights relating to information that Excelhire controls independently, you may contact us using the details in Section 16. 

11.1 Account and Data Deletion 

Excelhire accounts are created and managed by the subscribing Organization’s administrator; the Excelhire Mobile App does not offer public self-registration. You may request deletion of your account and associated Personal Data at any time by either: 

  • Contacting your Organization’s administrator, who can deactivate or delete your account; or 
  • Emailing us directly at privacy@excelhire.us (or contact@excelhire.us) with the subject line “Account Deletion Request.” 

Upon a verified request, we will delete or de-identify the associated Personal Data within a commercially reasonable time, except where we are required or permitted by applicable law, contractual obligation, or legitimate business need (such as security, fraud prevention, dispute resolution, or legal compliance) to retain it. Deleting your account removes your access to the Service. 

12. Children’s Privacy 

The Service is intended for business and workplace use by staffing and recruitment organizations. It is not directed to children, and we do not knowingly collect Personal Data from children under the age of 16. If we become aware that Personal Data has been collected from a child in violation of applicable law, we will take appropriate steps to delete the information. 

13. Links to Third-Party Websites 

The Service may contain links to websites or services that are not operated by Excelhire. If you follow a third-party link, you will be directed to that third party’s site or service. We encourage you to review the third party’s privacy policy. Excelhire is not responsible for the content, privacy policies, or practices of third-party websites or services. 

14. Changes to This Privacy Policy 

We may update this Privacy Policy from time to time to reflect changes in our products, services, legal obligations, or business practices. The updated version will be posted on this page with a revised “Last updated” date. Where required by applicable law or when changes are material, we may also notify Customers and users through the Service, by email, or by another appropriate communication method. 

15. Affiliated Domains and Services 

Agentic Talent AI, accessible through www.agentictalentai.com, and Excelhire, accessible through www.excelhire.us and www.excelhire.com, are operated under common ownership and management. References to “Excelhire,” “ExcelHire,” “Agentic Talent AI,” or “the Company” in this Privacy Policy refer to the same legal entity and its associated domains, unless otherwise stated.
